PRESS COMMUNIQUÉ BY THE GOVERNMENT OF BRAZIL

The Government of Brazil receives with great satisfaction the decision by the Government of the United States to withdraw the panel against Brazil at the WTO concerning the compatibility of Article 68 of the Brazilian Industrial Property Law (Law 9279/96) with the TRIPs Agreement. In the event it deems necessary to apply Article 68 to grant compulsory licenses on patents held by U.S. companies, the Brazilian Government agrees to hold prior talks with the U.S. Government. These talks would be held within the scope of the U.S.-Brazil Consultative Mechanism, in a special session scheduled to discuss the subject.

Brazil maintains its conviction that Article 68 is fully consistent with the TRIPs Agreement and an important instrument available to the Government, in particular in its efforts to increase access of the population to medicines and to combat diseases such as AIDS.

O Governo brasileiro acolhe com muita satisfação a decisão do Governo dos Estados Unidos de encerrar o painel na OMC contra o Brasil a respeito da compatibilidade do Artigo 68 da Lei de Propriedade Industrial (Lei 9.279/96) com o Acordo TRIPS. O Governo brasileiro compromete-se a manter conversações prévias com o Governo americano na eventualidade de julgar necessário aplicar o Artigo 68 para conceder licença compulsória de patente de empresa dos EUA. Tais conversações seriam mantidas no âmbito do Mecanismo Consultivo Brasil - Estados Unidos, em sessão especial para discutir o assunto.

O Brasil mantém a sua convicção de que o Artigo 68 é plenamente consistente com o acordo de TRIPS e importante instrumento de que dispõe o Governo, particularmente nos esforços de ampliar o acesso da população a medicamentos e de combater doenças como a AIDS.
